VISPĀRĪGIE NOTEIKUMI UN NOSACĪJUMI (VNN) INTERNETA VEIKALA UN WESTWING DIZAINA PAKALPOJUMU IZMANTOŠANAI WWW.WESTWING.EE, WWW.WESTWING.LV, WWW.WESTWING.LT
Zemāk ir izklāstīti mūsu Vispārīgie noteikumi un nosacījumi (turpmāk "VNN"), kurus mēs piemērojam Westwing interneta veikala izmantošanai tīmekļa vietnēs www.westwing.ee, www.westwing.lv un www.westwing.lt. Veicot pasūtījumu, jūs piekrītat šādiem VNN, ko izstrādājusi Westwing GmbH, Moosacher Str. 88, 80809 Minhenē (turpmāk "Westwing").
Šie VNN attiecas uz patērētājiem, kuru rēķinu adrese ir Igaunijā, Latvijā vai Lietuvā un kuri izmanto piedāvājumus mūsu tīmekļa vietnē. Patērētājs šo VNN izpratnē ir jebkura fiziska persona, kas noslēdz tiesisku darījumu nolūkos, kas galvenokārt nav saistīti ne ar komercdarbību, ne ar neatkarīgu profesionālo darbību.
1. VISPĀRĪGA INFORMĀCIJA UN DARBĪBAS JOMA
1.1 Westwing vada tiešsaistes veikalu tīmekļa vietnēs www.weswting.ee, www.westwing.lv un www.westwing.lt.
1.2 Lai izmantotu tiešsaistes veikalā pieejamos piedāvājumus, personām jābūt vismaz 18 gadu vecumā.
1.3 Preces un pakalpojumi parasti tiek pārdoti tikai mājsaimniecībām ierastos apjomos.
1.4 Šie Vispārīgie noteikumi un nosacījumi attiecas uz visiem līgumiem, kas noslēgti tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt, ja vien nav spēkā atsevišķie B2B Vispārīgie noteikumi un nosacījumi uzņēmējiem.
1.5 Ja termiņi ir norādīti (darba) dienās, tajos ietilpst visas darba dienas, izņemot sestdienas, svētdienas un valsts svētku dienas attiecīgajās valstīs un Vācijā.
2. REĢISTRĀCIJA UN TĪMEKĻA VIETŅU WWW.WESTWING.EE, WWW.WESTWING.LV VAI WWW.WESTWING.LT IZMANTOŠANA
2.1 Pasūtot preces, jums tiks lūgts norādīt personas datus, kuri tiks vākti un apstrādāti saskaņā ar Westwing privātuma politiku. Tiek piemērots 19. punkts.
2.2 Jūs esat atbildīgs par to, lai dati būtu pilnīgi un precīzi. Jums ir arī pienākums uzturēt savus datus atjauninātus. Ja dati, kurus esat norādījis, mainās tīmekļa vietnes lietošanas laikā, Jums ir nekavējoties jālabo informācija. Jums ir pienākums konfidenciāli izturēties pret savām parolēm un jebkuriem citiem piekļuves datiem un aizsargāt tos no neatļautas trešo personu piekļuves.
2.3 Jūs esat vienīgais atbildīgais par jebkādu saturu (piemēram, produktu atsauksmēm), ko publicējat šim nolūkam paredzētajās vietās. Jūs garantējat, ka jūsu paša saturs neaizskar vai nepārkāpj trešo personu tiesības (piemēram, personiskās tiesības vai autortiesības). Šajā saistībā jūs pilnībā atbrīvojat Westwing no jebkādām trešo personu prasībām pēc pirmā pieprasījuma. Iesniedzot saturu Westwing, jūs piešķirat Westwing un visiem ar Westwing saistītajiem uzņēmumiem Westwing Group ietvaros (turpmāk "Westwing Group") visas vienkāršās lietošanas tiesības, kas nav ierobežotas laikā, vietā un saturā, ieskaitot tiesības nodot šādas tiesības trešajām personām, kas Westwing nepieciešamas, lai publicētu un izplatītu saturu, pilnībā vai daļēji, Westwing Group tīmekļa vietnēs
2.4 Savā klienta kontā jūs varat apskatīt savus atvērtos, nesen nosūtītos un/vai pabeigtos pasūtījumus un nepieciešamības gadījumā tos mainīt, kā arī diferencēti pārvaldīt un glabāt savus datus, kuponus, jaunumus un paziņojumus.
2.5 Jūs drīkstat reģistrēties tikai ar vienu klienta kontu tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt un vienlaikus drīkstat izmantot tikai vienu klienta kontu. Ja Westwing atklāj vairākas reģistrācijas, Westwing var tās dzēst.
2.6 Aizliegts izmantot tīmekļa vietnes www.westwing.ee, www.westwing.lv un www.westwing.lt un to saturu nelikumīgiem, ļaunprātīgiem vai šajos VNN aizliegtiem mērķiem. Jo īpaši tehniskos procesus nedrīkst traucēt vai ar tiem manipulēt. Gadījumā, ja tiek novērota rīcība vai mēģinājumi gūt neatļautas priekšrocības, kaitējot Westwing vai citiem klientiem, Westwing patur tiesības bloķēt klienta kontu un nepieņemt piedāvājumus.
2.7 Westwing patur tiesības, ievērojot privātās autonomijas principu, pēc saviem ieskatiem izmantot savas virtuālās mītnes tiesības un, piemēram, izteikt brīdinājumus, noraidīt pasūtījumus, ierobežot pieejamos maksājumu veidus, pārtraukt piekļuvi tīmekļa vietnēm www.westwing.ee, www.westwing.lv vai www.westwing.lt vai dzēst nosūtīto saturu, ja tiek pārkāpti šie VNN vai ja tiek novērota ļaunprātīga rīcība. Jūsu atteikuma tiesības saskaņā ar 13. punktu nekādā veidā netiek ierobežotas ar iepriekš minētajiem pasākumiem. Tas neietekmē Westwing prasības par zaudējumu atlīdzību.
3. LĪGUMSLĒDZĒJS, VALODA UN LĪGUMA NOSLĒGŠANA
3.1 Līgumslēdzējs partneris, slēdzot līgumus tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt, ir Westwing.
3.2 Tīmekļa vietnes, www.westwing.ee, www.westwing.lv vai www.westwing.lt ir pieejamas angļu un lietuviešu valodā.
Līgumi, kas noslēgti, izmantojot tīmekļa vietni, tiek noslēgti tikai igauņu, latviešu vai lietuviešu valodā.
3.3 Preču piedāvājums vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt nav saistošs līguma piedāvājums Vācijas Civilkodeksa (BGB) 145. panta izpratnē, bet ir uzskatāms par nesaistošu aicinājumu iesniegt piedāvājumu (tā saukto "invitatio ad offerendum"). Pēc tam, kad izvēlētās preces un pakalpojumi ir ievietoti virtuālajā grozā un elektroniskā pasūtīšanas process ir pabeigts, jūs iesniedzat juridiski saistošu līguma piedāvājumu par precēm un pakalpojumiem, kas pašlaik atrodas virtuālajā grozā, noklikšķinot uz pogas "Pirkt tagad". Pēc piedāvājuma iesniegšanas Jūs saņemsiet e-pastu no Westwing, kas apstiprina jūsu piedāvājuma saņemšanu. Šis e-pasts no Westwing nav līguma pieņemšana. Westwing ir tiesības lemt nepieņemt piedāvājumus. Ja pasūtījums netiek izpildīts no Westwing puses, Westwing jūs par to nekavējoties informēs. Līgums tiek pieņemts ar atsevišķu e-pastu, kurā ir apstiprinājums par preču nosūtīšanu vai pakalpojuma sniegšanu, bet ne vēlāk kā pēc preču nosūtīšanas.
3.4 Westwing saglabās pasūtījuma datus un nosūtīs tos jums e-pastā pēc pasūtījuma izpildes. Šajā e-pastā ir iekļauti arī pasūtījuma atcelšanas noteikumi. Jūs varat arī jebkurā brīdī apskatīt VNN vietnē www.westwing.ee, www.westwing.lv vai www.westwing.lt. Ja pirms pasūtījuma iesniegšanas esat izveidojis klienta kontu, jūs vienmēr varat apskatīt pasūtījuma informāciju pieteikšanās zonā. Tas attiecas arī uz iepriekš veiktiem pasūtījumiem saskaņā ar likumā noteikto informācijas uzglabāšanas pienākumu.
3.5 Pasūtījuma apstrāde un saziņa parasti notiek, izmantojot automatizētu pasūtījuma apstrādi vai e-pastu. Jums ir jānodrošina, ka e-pasta adrese, ko norādāt pasūtījuma apstrādei, ir pareiza, lai Westwing nosūtītos e-pastus jūs varētu saņemt šajā adresē. Jo īpaši, ja izmantojat surogātpasta filtrus, jums ir jānodrošina, ka visi e-pasti, ko nosūta Westwing vai trešās personas, kuras Westwing ir pilnvarojis pasūtījuma apstrādei, var tikt piegādāti.
4. CENAS UN PIEGĀDES IZMAKSAS
4.1 Preču pasūtījumiem tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt tiek piemērotas cenas, kas norādītas attiecīgajā preces apraksta lapā pasūtījuma veikšanas brīdī. Cenas ir galīgās cenas, ieskaitot likumā noteikto pievienotās vērtības nodokli un iepakojuma izmaksas. Cenai tiek papildus pieskaitītas piegādes izmaksas un, ja attiecināms, izmaksas par papildus pasūtāmo montāžas pakalpojumu (skatīt 5. punktu).
4.2 Preču cenas jūsu virtuālajā grozā vienmēr atbilst aktuālajai cenai preces apraksta lapā. Tas nozīmē, ka aktuālā preces cena var atšķirties no cenas, par kādu jūs pievienojāt preci savam virtuālajam grozam. Pievienojot preci savam virtuālajam grozam, jūs nerezervējat tajā brīdī parādīto cenu. Preces cena var palielināties vai samazināties laikā starp brīdi, kad jūs to pievienojat savam virtuālajam grozam, un brīdi, kad jūs to faktiski iegādājaties.
4.3 Piegādes izmaksas tiek aprēķinātas atsevišķi katram pasūtījumam un ir atkarīgas no cenas, kas norādīta preces apraksta lapā. Tās ir atkarīgas, cita starpā, no preces izmēra, svara un piegādes veida. Piegādes veidu nosaka Westwing pēc saviem ieskatiem.
5. WESTWING DIZAINA PAKALPOJUMI
5.1 Ar Westwing dizaina pakalpojumiem Westwing piedāvā individuālas interjera dizaina konsultācijas tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt (turpmāk tekstā — „Westwing dizaina pakalpojums(-i)” vai „Pakalpojums”). Šie Vispārīgie noteikumi attiecas uz šiem pakalpojumiem, ja vien turpmāk nav norādīts citādi.
5.2 Pakalpojumi tiek sniegti tiešsaistē, izmantojot videočatu vai videokonferenci ar ekrāna koplietošanu, kādā no Westwing fiziskajām veikaliem (Veikali | Westwing) vai, ja runa ir par Westwing Design Services Deluxe, daļēji arī uz vietas. Konkrētos Westwing Design Services pakalpojumus, kas tiek piedāvāti jūsu valstī, varat atrast tīmekļa vietnē.
5.3 Pakalpojumus sniedz Westwing vai Westwing apakšuzņēmējs.
5.4 Kā daļu no Westwing dizaina pakalpojumiem Jūs saņemsiet profesionālu interjera dizaina koncepciju, kas balstīta uz Jūsu sniegto informāciju, kopā ar personīgo iepirkumu sarakstu. Konkrētais pakalpojumu apjoms un attiecīgās izmaksas par atsevišķiem Westwing dizaina pakalpojumiem ir norādīti tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt sadaļā „Dizaina pakalpojumi”.
5.5 Westwing patur tiesības atteikt Westwing dizaina pakalpojumus vai to sniegšanu, ja esat sniedzis nepareizu informāciju par telpām, ja rīkojaties nelikumīgi vai amorāli vai pārkāpjot šos Vispārīgos noteikumus.
5.6 Westwing patur tiesības atcelt pakalpojumu sniegšanas tikšanās laiku līdz 12 stundām pirms tikšanās laika gadījumos, kas ir ārpus Westwing kontroles (piemēram, nepārvarama vara), un informēs jūs par jebkādu atcelšanu iepriekš. Gadījumos, kad tikšanās laiks tiek atcelts, jums tiks piedāvāts jauns tikšanās laiks vai naudas atmaksa, ja jaunu tikšanās laiku nav iespējams noorganizēt. Jūs varat arī bez maksas pārplānot saskaņoto tikšanos līdz 12 stundām pirms tās. Šajā gadījumā Westwing piedāvās Jums alternatīvu tikšanos, ja tāda būs pieejama.
5.7 Pēc tam, kad ir sniegts pēdējais pakalpojums kā daļa no rezervētajiem Westwing dizaina pakalpojumiem, līgumiskās attiecības par šo konkrēto Westwing dizaina pakalpojumu automātiski beidzas. Ja pēc jūsu lūguma ir nepieciešama sniegto Westwing dizaina pakalpojumu pārveidošana vai pārkārtošana, jums ir jārezervē jauns Westwing dizaina pakalpojums caur tīmekļa vietni.
5.8 Autortiesības un citas intelektuālā īpašuma tiesības, kas attiecas uz interjera dizaina koncepcijām un telpu koncepcijām, kuras izstrādājis Westwing un/vai Westwing dizaina pakalpojumu ietvaros, pieder ekskluzīvi Westwing. Westwing piešķir jums vienkāršas, beztermiņa un nepārvedamas tiesības personiskai lietošanai saistībā ar pakalpojumiem, kas sniegti Westwing dizaina pakalpojumu ietvaros. Komerciāla, publiska izmantošana ir atļauta tikai ar Westwing iepriekšēju rakstisku piekrišanu. Westwing ir tiesīgs izmantot Westwing dizaina pakalpojumu rezultātus reklāmas nolūkos (piemēram, kā plānošanas piemērus tīmekļa vietnē) ar jūsu iepriekšēju piekrišanu.
5.9 Jūs esat atbildīgs par to, lai Westwing tiktu sniegta informācija un dokumenti (piem., plāni), kas var būt būtiski pakalpojuma sniegšanai.
6. MAKSĀJUMU NOSACĪJUMI UN MAKSĀJUMI
6.1 Par precēm un pakalpojumiem varat samaksāt, izmantojot šādus jūsu valstī pieejamos maksājumu veidus:
Igaunija: PayPal, kredītkarte (VISA, Mastercard, American Express), GooglePay (pieejams tikai pasūtot caur tīmekļa pārlūku), ApplePay, Trustly, Ivy un priekšapmaksa.
Latvija: PayPal, kredītkarte (VISA, Mastercard, American Express), GooglePay (pieejams tikai pasūtot caur tīmekļa pārlūku), ApplePay, Trustly, Ivy un priekšapmaksa.
Lietuva: PayPal, kredītkarte (VISA, Mastercard, American Express), GooglePay (pieejams tikai pasūtot caur tīmekļa pārlūku), ApplePay, Trustly, Ivy un priekšapmaksa.
6.2 Westwing pieņem dažādas kredītkartes, pašlaik: VISA un Mastercard, kā arī American Express. Westwing norakstīs rēķina summu no jūsu kredītkartes pēc pasūtījuma saņemšanas, izmantojot mūsu maksājumu pakalpojumu sniedzēju Stripe Payments Europe Ltd (reģistrēts Īrijas Komercreģistrā ar numuru 3206488LH).
6.3 Maksājumu metodes ApplePay un GooglePay tiek apstrādātas ar maksājumu pakalpojumu sniedzēja Stripe Payments Europe Ltd (reģistrēts Īrijas Komercreģistrā ar numuru 32064LH) starpniecību.
6.4 Ja izvēlaties PayPal piedāvāto maksājumu metodi, maksājumu apstrādās maksājumu pakalpojumu sniedzējs PayPal (Eiropa) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luksemburga (reģistrēts Komercreģistrā ar numuru R.C.S. Luksemburga B 118 349), saskaņā ar PayPal lietošanas noteikumiem, kas pieejami:

6.5 Maksājumu apstrādei mēs izmantojam maksājumu pakalpojumu sniedzēju Mollie B.V., Keizersgracht 126, 1015 CW, Amsterdama, Nīderlande. Mollie piedāvā, cita starpā, Trustly un Ivy maksājumu metodes. Apstrādājot maksājumus, jūsu norādītie maksājuma dati (piemēram, IBAN, vārds, uzvārds, rēķina summa) tiek nosūtīti uz Mollie. Vairāk informācijas par Mollie datu apstrādi varat atrast tās privātuma politikā: https://www.mollie.com/ee/privacy, https://www.mollie.com/lv/privacy vai https://www.mollie.com/lt/privacy.
6.6 Ja izvēlaties bankas pārskaitījumu, pēc pasūtījuma pabeigšanas pa e-pastu saņemsiet rēķinu un Westwing bankas rekvizītus. Rēķina summa jāpārskaita uz Westwing kontu 7 kalendāro dienu laikā no pasūtījuma apstiprinājuma saņemšanas. Preces tiks nosūtītas vai pakalpojums sniegts tikai pēc pilnas maksājuma saņemšanas. Veicot pārskaitījumu, lūdzu, kā maksājuma uzdevumu norādiet pasūtījuma numuru.
7. RĒĶINS
7.1 Pieņemot VNN, jūs piekrītat, ka Westwing var jums nosūtīt rēķinus elektroniski vai darīt tos pieejamus elektroniski saskaņā ar Padomes Direktīvas 2006/112/EK 232. pantu.
7.2 Lūdzu, ņemiet vērā, ka, ja dati, kurus norādāt pasūtījuma veikšanas brīdī, neatbilst 2.2. punktā minētajiem nosacījumiem, Westwing nevarēs izrakstīt korekcijas rēķinu, lai labotu jūsu datus pēc līguma noslēgšanas.
8. KUPONI
8.1 Westwing piedāvā dažāda veida kuponus: dāvanu kuponus, akcijas kuponus un kompensācijas kuponus:
8.1.1 Dāvanu kuponi
8.1.1.1 Dāvanu kuponi ir kuponi, kurus varat iegādāties veikalā un izmantot tikai tajā tīmekļa vietnē, kurā tos iegādājāties (www.weswting.ee, www.westwing.lv vai www.westwing.lt), ja vien kuponā nav norādīts citādi. Dāvanu kupons tiks nosūtīts uz Jūsu e-pastu pēc pasūtījuma veikšanas.
8.1.1.2 Dāvanu kuponus un atlikušo kredītu no dāvanu kuponiem var izmantot līdz trešā gada beigām pēc gada, kurā kupons tika iegādāts.
8.1.1.3 Dāvanu kuponus var izmantot tikai preču un pakalpojumu iegādei, un tās nevar izmantot, lai iegādātos papildu dāvanu kuponus.
8.1.1.4 Ja pasūtījuma cena pārsniedz dāvanu kupona atlikumu, starpību var samaksāt, izmantojot piedāvātos maksājumu veidus. Ja pasūtījuma cena ir mazāka par dāvanu kupona atlikumu, atlikušo summu var izmantot nākamajā pasūtījumā.
8.1.1.5 Ja līgums tiek atcelts – neatkarīgi no iemesla – pirkuma cena tiks atmaksāta, veicot atgriezenisko ierakstu dāvanu kartes kontā un, ja nepieciešams, izmantojot papildu maksājuma metodi.
8.1.1.6 Dāvanu kupons ir nododams citai personai.
8.1.1.7 Zaudēti kupona kodi, jo īpaši nozagti kupona kodi, netiks atlīdzināti. Westwing neuzņemas atbildību par zaudētiem kupona kodiem.
8.1.2 Reklāmas kuponi (ieskaitot "Iesaki draugam kuponus")
8.1.2.1 Reklāmas kuponi ir kuponi, kas tiek izsniegti bez maksas kā daļa no reklāmas kampaņām ar konkrētu derīguma termiņu un kurus jūs nevarat iegādāties. Reklāmas kuponus var izmantot tikai kuponā norādītajā tīmekļa vietnē (www.westwing.ee, www.westwing.lv vai www.westwing.lt) norādītajā periodā, bet tos nevar izmantot, lai segtu piegādes vai montāžas izmaksas. Uz reklāmas kuponiem var attiekties papildu individuāli noteikumi un nosacījumi. Tie tiks paziņoti jums tieši saistībā ar kuponu.
8.1.2.2 Kuponi, kurus esat saņēmis kā jauns klients, pamatojoties uz Westwing dalībnieka uzaicinājumu (tā sauktais "Iesaki draugam kupons"), nevar izmantot, ja Jums jau ir konts Westwing, jo kuponu var izmantot tikai jauni klienti.
8.1.2.3 Pirmreizējās reģistrācijas vai jauno klientu kuponi, kurus jūs saņemat vienreiz par reģistrāciju tīmekļa vietnēs www.westwing.ee, www.westwing.lv vai www.westwing.lt, var izmantot tikai vienu reizi vienam klienta kontam.
8.1.2.4 Vienā pasūtījumā var izmantot tikai vienu akcijas kuponu. Nav iespējams atgūt vai ieskaitīt akcijas kupona atlikumu, kas rodas, ja pirkuma vērtība ir mazāka par kupona vērtību.
8.1.2.5 Reklāmas kupons nav nododams citai personai, nav atgūstams un to nevar izmantot atkārtoti, ja jūs atgriežat preces vai pakalpojumus, kas pilnībā vai daļēji apmaksāti ar kuponu, likumā noteiktā atteikuma termiņa laikā. Ja pasūtītās preces tiek atgrieztas daļēji, kupona vērtība tiks sadalīta proporcionāli starp pasūtītajām precēm, t.i., atgriežot atsevišķus priekšmetus, kupons tiks ieskaitīts proporcionāli atgriezto preču cenai un zaudēs spēku proporcionāli preču vērtībai. Ja kupons ir saistīts ar minimālo pasūtījuma summu, tā ir jāsasniedz arī tad, ja preces tiek atgrieztas daļēji, pretējā gadījumā kupona vērtība netiks ieskaitīta.
8.1.3 Kompensācijas kuponi
8.1.3.1 Kompensācijas kuponi ir kuponi, kurus nevar iegādāties, bet kurus Westwing izsniedz pēc saviem ieskatiem kā kompensāciju, neatzīstot nekādas juridiskas saistības.
8.1.3.2 Attiecīgi tiek piemēroti noteikumi, kas attiecas uz reklāmas kuponiem.
8.2 Ja ir pamatotas aizdomas par krāpšanu vai citām nelikumīgām vai neatbilstošām darbībām saistībā ar kupona iegādi vai izmantošanu, Westwing var bloķēt attiecīgo kupona kodu (pat uz laiku) vai atteikt izmantošanu (pat uz laiku). Pēdējā gadījumā jums ir tiesības atcelt pasūtījumu.
8.3 Kupona summu nevar izmaksāt, to nevar nodot par atlīdzību, kā arī to nevar vēlāk ieskaitīt jau veiktajos pirkumos, t. i., pēc pasūtījuma procesa pabeigšanas.
8.4 Iepriekšminētos kuponus var izmantot tikai patērētāji.
9. PIEGĀDES UN SŪTĪŠANAS NOSACĪJUMI
9.1 Piegādes tiek veiktas tikai Igaunijas, Latvijas un Lietuvas teritorijā uz jūsu norādīto piegādes adresi.
9.2. Standarta piegādes termiņi tiks norādīti attiecīgā produkta informācijas lapā.
9.3 Pasūtītās preces tiks nosūtītas vai nu kā sūtījums, vai ar ekspeditora starpniecību pēc Westwing ieskatiem.
9.4 Westwing neuzņemas nekādu iepirkuma risku, jo īpaši gadījumos, kad tiek veikti vispārīgi standarta pirkumi. Westwing ir pienākums piegādāt preces tikai no esošajiem krājumiem vai no piegādātājiem pasūtītām precēm. Westwing piegādes pienākums zaudē spēku, ja, neraugoties uz esošu darījumu saistību izpildei ar attiecīgo piegādātāju, Westwing nesaņem piegādi, nesaņem pilnīgu piegādi vai nesaņem piegādi laicīgi un par to nav atbildīgs, ir jūs nekavējoties informējis un nav skaidri vienojies par atsevišķu iepirkuma risku. Jebkādas avansa maksas Westwing atmaksā.
9.5 Westwing nevar tikt saukts pie atbildības par Westwing saskaņā ar šo līgumu uzņemtā pienākuma nepildīšanu vai nepilnīgu pildīšanu, ja un ciktāl tas ir saistīts ar nepārvaramu varu, neatkarīgi no tā, ka Westwing darīs visu, kas ir tā spēkos, lai mazinātu šāda notikuma sekas.
Nepārvarama vara ietver visus neparedzētus notikumus vai notikumus, kuri, pat ja tie ir paredzami, ir ārpus Westwing kontroles un kuru ietekmi uz līguma izpildi Westwing nevarēja novērst, pieliekot saprātīgas pūles. Tie ietver, cita starpā, karu, karam līdzīgus apstākļus, nemierus, sacelšanos, militārus vai pilsoniskus apvērsumus, dumpjus, masu nekārtības, embargo, valdības rīkojumu, ugunsgrēku, plūdus, vētru paisumus, viesuļvētras vai citas katastrofāla mēroga vētras, zemestrīces, zibens spērienus, pandēmijas, epidēmijas, kodolkatastrofas vai līdzīgus iemeslus, kas ir ārpus Westwing kontroles un kuru dēļ izpildīt vai ievērot šajos VNN noteiktās saistības kļūst prettiesiski, neiespējami vai ekonomiski neizdevīgi. Ja rodas nepārvaramas varas apstākļi, Westwing ir pienākums jūs par to nekavējoties informēt. Westwing tiek atbrīvots no savas saistību izpildes uz šī notikuma ilguma laiku. Piegādes un izpildes termiņi tiek atbilstoši pagarināti. Ja nepārvaramas varas apstākļi ilgst ilgāk par 8 nedēļām, Westwing un jums ir tiesības atkāpties no līguma.
9.6 Ja preču piegāde neizdodas iemeslu dēļ, par kuriem esat atbildīgs, Westwing jums aprēķinās jaunas piegādes izmaksas un saprātīgas uzglabāšanas izmaksas no neizpildītās piegādes dienas. Ja sākotnējā piegāde jums bija bezmaksas, par jauno piegādi tiks iekasēta maksa. Mēs jūs informēsim par papildu izmaksām pirms atkārtotās piegādes un veiksim piegādi tikai ar jūsu piekrišanu. Lūdzu, ņemiet vērā, ka atteikšanās pieņemt piegādi nav uzskatāma par jūsu atteikuma tiesību efektīvu izmantošanu un par to ir skaidri jāpaziņo Westwing. Westwing patur tiesības atkāpties no līguma, ja jūs 7 dienu laikā nesniedzat piekrišanu atkārtotai piegādei. Šādā gadījumā Westwing atmaksās jebkādus jau veiktos maksājumus. Tas attiecas arī uz gadījumiem, ja jūs efektīvi izmantojat savas atteikuma tiesības. Šādā gadījumā jums tiks atmaksātas arī sākotnējās piegādes izmaksas (standarta piegāde).
10. GARANTIJA, ATBILDĪBA UN TRANSPORTA BOJĀJUMI
10.1 Tiek piemēroti likumā noteiktie noteikumi par atbildību par defektiem. Attiecībā uz pretenzijām par defektiem lietotās preces gadījumā patērētāji nevar iebilst pret defektiem, kas bija norādīti pirms pirkuma.
10.2 Lietuvā līgumiem par lietotu preču piegādi piemēro šādu ierobežojumu: prasību par defektiem noilguma termiņš ir viens gads no preču piegādes brīža.
10.3 Neatkarīgi no obligātajiem normatīvajiem aktiem, Westwing atbildība ir ierobežota gadījumiem, kad Westwing ir pieļāvusi rupju neuzmanību vai tīšu pārkāpumu.
10.4 Iepriekš minētie atbildības ierobežojumi un izņēmumi saskaņā ar 10.3. punktu nav attiecināmi, ja Westwing ir krāpnieciskā veidā slēpis defektu vai ir uzņēmies garantiju par precēm vai ja atbildību nevar ierobežot vai izslēgt saskaņā ar piemērojamiem tiesību aktiem.
10.5 Ja preces tiek piegādātas ar acīmredzamiem iepakojuma vai satura bojājumiem, lūdzu, ziņojiet par to piegādes uzņēmumam un sazinieties ar Westwing klientu apkalpošanas dienestu (Igaunijā: service@westwing.ee, Lietuvā: service@westwing.lt un Latvijā: service@westwing.lv). Šis ziņojums neietekmē jūsu garantijas tiesības.
11. GARANTIJAS
Papildu garantija pastāv tikai tad, ja tā ir skaidri norādīta un aprakstīta produkta informācijas lapā.
12. PATĒRĒTĀJA ATSAUKŠANĀS TIESĪBAS
Jums ir tiesības četrpadsmit (14) dienu laikā atteikties no šā līguma, neminot iemeslu. Atteikšanās termiņš ir četrpadsmit dienas no dienas, kad jūs vai jūsu norādīta trešā persona, kas nav pārvadātājs, esat saņēmis preci.
Lai izmantotu savas atteikuma tiesības, jums ir jāinformē mūs par savu lēmumu atteikties no šī līguma, nosūtot skaidru paziņojumu (piemēram, vēstuli pa pastu vai e-pastu). Šim nolūkam varat izmantot šādu atteikuma veidlapas paraugu, taču tas nav obligāti:

Atteikuma tiesības neattiecas vai zaudē spēku šādu līgumu gadījumā:
par tādu preču piegādi, kuras veselības aizsardzības vai higiēnas apsvērumu dēļ nav piemērotas atgriešanai un kuru plombas ir noņemtas pēc piegādes vai kuras pēc piegādes ir sajauktas ar citām precēm tādā veidā, ka to dabas dēļ tās nav iespējams atdalīt;

par tādu preču piegādi, kuras var ātri sabojāties vai kuru derīguma termiņš drīz beigsies.
13. ATTEIKUMA SEKAS
Ja esat atcēlis pirkuma līgumu, mēs nekavējoties un ne vēlāk kā četrpadsmit (14) dienu laikā no dienas, kad saņemam paziņojumu par līguma atcelšanu, atmaksāsim visus no jums saņemtos maksājumus, ieskaitot piegādes izmaksas. Atmaksai izmantosim to pašu maksājuma veidu, ko izmantojāt sākotnējā darījumā, ja vien ar jums neesam skaidri vienojušies citādi. Nekādā gadījumā jums netiks piemērota maksa par šo atmaksu. Mēs varam atteikties veikt atmaksu, kamēr neesam saņēmuši preces atpakaļ vai kamēr jūs neesat iesniedzis pierādījumu, ka esat preces nosūtījis atpakaļ, atkarībā no tā, kas notiek agrāk.

14. PATĒRĒTĀJU BRĪVPRĀTĪGĀS ATGRIEŠANAS TIESĪBAS
14.1 Visos preču pirkumos Westwing piešķir jums brīvprātīgas atgriešanas tiesības 30 dienu laikā no preču saņemšanas, papildus likumā noteiktajām atteikuma tiesībām saskaņā ar 12. punktu. Ar šīm brīvprātīgajām atgriešanas tiesībām jūs varat atteikties no pirkuma līguma pat pēc 14 dienu atteikuma termiņa (skatīt 12. punktu) beigām, nosūtot preces atpakaļ Westwing 30 dienu laikā no to saņemšanas.
Tomēr, lai izmantotu brīvprātīgās atgriešanas tiesības, preces jāatgriež pilnā komplektā, nevainojamā stāvoklī un nesabojātas to oriģinālajā pārdošanas iepakojumā. Pretējā gadījumā Westwing patur tiesības atteikt atgriešanu. Vēlamies norādīt, ka, atgriežot preces saskaņā ar brīvprātīgajām atgriešanas tiesībām, transporta risks ir jūsu ziņā. Brīvprātīgās atgriešanas tiesības neattiecas uz dāvanu kuponu iegādi.
14.2 Atmaksa tiks veikta, izmantojot to pašu maksājuma veidu, ko izmantojāt maksājumam. Ja kā maksājuma veids tika izvēlēta tiešā debetēšana, nav nepieciešams iebilst pret tiešo debetēšanu.
14.3 Jūsu likumā noteiktās atteikuma tiesības (sk. 12. punktu) netiek ietekmētas, ievērojot šajā 12. punktā izklāstītos nosacījumus, un tās saglabājas neatkarīgi no tiem. Līdz likumā noteikto atteikuma tiesību termiņa beigām ir spēkā tikai tur uzskaitītie likumā noteiktie nosacījumi. Šīs līgumā noteiktās (brīvprātīgās) atgriešanas tiesības neierobežo jūsu likumā noteiktās garantijas tiesības, kas paliek neierobežotas.
15. PIEGĀDES UN PAKALPOJUMU IZMAKSU ATLĪDZINĀŠANA DAĻĒJAS ATCELŠANAS GADĪJUMĀ
Ja jūs atceļat līgumu tikai par daļu no pasūtījumā iekļautajām precēm (daļēja atcelšana), Westwing atmaksās maksājumus par precēm, uz kurām attiecas atcelšana, ieskaitot piegādes un montāžas izmaksas (ja preces vēl nav samontētas). Tomēr, ja (daļa no) piegādes un montāžas izmaksām būtu radušās pat tad, ja jūs būtu pasūtījuši tikai tās preces, par kurām jūs neatceļat līgumu, šīs izmaksas netiek iekļautas atmaksājamajā summā.
16. ĪPAŠUMA TIESĪBU SAGLABĀŠANA
Preces paliek Westwing īpašumā, līdz ir veikta pilna apmaksa.

3. CONTRACTUAL PARTNER, LANGUAGE AND CONCLUSION OF THE CONTRACT

3.2 The websites www.westwing.ee, www.westwing.lv or www.westwing.lt are operated in English, for Lithuania in the given jurisdiction. Contracts via the website are concluded exclusively in Estonian, Latvian or Lithuanian.
3.3 The offer of goods on www.westwing.ee, www.westwing.lv or www.westwing.lt is not a binding contractual offer within the meaning of § 145 BGB (German Civil Code), but is to be understood as a non-binding invitation to submit an offer (so-called "invitatio ad offerendum"). 4. PRICES AND SHIPPING COSTS

5.2 The services are provided online via video chat or video conference with screen sharing, in one of the Westwing offline stores (Stores | Westwing) or, in the case of Westwing Design Services Deluxe, partly also on site. You can find the specific Westwing Design Services offered in your country on the website.
5.3 The services are provided by Westwing or a subcontractor of Westwing.
5.4 As part of Westwing Design Services, you will receive a professional interior design concept based on the information you provide, along with a personal shopping list. The exact scope of services and the respective costs of the individual Westwing Design Services are listed on the websites www.westwing.ee, www.westwing.lv or www.westwing.lt in the Design Service section.
5.5 Westwing reserves the right to refuse the Westwing Design Services or their performance if you have provided incorrect information regarding the premises, if you act in a manner that is unlawful or immoral or in violation of these GTC.
5.6 Westwing reserves the right to cancel appointments for the provision of services up to 12 hours before the appointment in cases beyond Westwing's control (e.g., force majeure) and will inform you in advance of any cancellation. In cases where an appointment is cancelled, you will be offered a new appointment or a refund if no new appointment can be arranged. You can also reschedule the agreed appointment free of charge up to 12 hours before the appointment. In this case, Westwing will offer you an alternative appointment subject to availability.
5.7 After the last service has been provided as part of the booked Westwing Design Services, the contractual relationship for this specific Westwing Design Service shall automatically end. If, at your request, a redesign or reorganisation of the Westwing Design Services provided is necessary, you must book a new Westwing Design Service via the website.
5.8 The copyright and other intellectual property rights relating to the interior design concepts and room concepts designed by Westwing and/or within the scope of the Westwing Design Services belong exclusively to Westwing. Westwing grants you simple, perpetual and non-transferable rights for personal use in relation to the services provided within the scope of the Westwing Design Services. Commercial, public use is only permitted with the prior written approval of Westwing. Westwing is entitled to use the results of the Westwing Design Services for advertising purposes (e.g. as planning examples on the website) with your prior consent.
5.9 You are responsible for providing Westwing with information and documents (e.g. floor plans) that may be relevant for the provision of the service.
6. PAYMENT TERMS AND PAYMENT
6.1 You can pay for the goods and services using the following payment methods offered in your country:
Estonia: PayPal, credit card (VISA, Mastercard, American Express), GooglePay (only available when ordering via a web browser), ApplePay, Trustly, Ivy and prepayment.
Latvia: PayPal, credit card (VISA, Mastercard, American Express), GooglePay (only available when ordering via a web browser), ApplePay, Trustly, Ivy and prepayment.
Lithuania: PayPal, credit card (VISA, Mastercard, American Express), GooglePay (only available when ordering via a web browser), ApplePay, Trustly, Ivy and prepayment.
6.2 Westwing accepts various credit cards, currently: VISA and Mastercard as well as American Express. Westwing will debit the invoice amount from your credit card after receipt of the order via our payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 3206488LH).
6.3 The payment methods ApplePay and GooglePay are processed via the payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 32064LH).
6.4 If you select a payment method offered by PayPal, payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (registered in the Commercial Register under R.C.S. Luxembourg B 118 349), subject to the PayPal Terms of Use, available at https://www.paypal.com/ee/webapps/mpp/ua/useragreement-full, https://www.paypal.com/lv/webapps/mpp/ua/useragreement-full, https://www.paypal.com/lt/webapps/mpp/ua/useragreement-full.
6.5 We use the payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands, to process payments. Mollie offers, among other things, the Trustly and Ivy payment method. When processing payments, the payment details you provide (e.g. IBAN, name, invoice amount) are passed on to Mollie. 6.6 If you choose bank deposit, you will receive an invoice and Westwing's bank details by email after completing your order. The invoice amount must be transferred to Westwing's account within 7 calendar days of receiving the order confirmation. The goods will only be shipped or the service provided once payment has been received in full. When making the transfer, please quote the order number as the reason for payment.
7. INVOICE
7.1 By accepting the GTC, you agree that Westwing may send you invoices electronically or make invoices available electronically in accordance with Article 232 of Council Directive 2006/112/EC.
7.2 Please note that, if the data you provide when ordering is not correct in line with paragraph 2.2 above, Westwing will not be able to issue a correction invoice to correct your data after the contract is formed.
8. VOUCHERS
8.1 Westwing offers various types of vouchers: gift vouchers, promotional vouchers and compensation vouchers:
8.1.1 Gift vouchers
8.1.1.1 Gift vouchers are vouchers that you can purchase in the shop and redeem only at the website you have purchased it from (www.weswting.ee, www.westwing.lv or www.westwing.lt), unless otherwise stated on the voucher. The gift voucher will be provided to you by email after ordering.
8.1.1.2 Gift vouchers and remaining credit from gift vouchers are redeemable until the end of the third year after the year in which the voucher was purchased.
8.1.1.3 Gift vouchers can only be used to purchase goods and services and cannot be used to purchase additional gift vouchers.
8.1.1.4 If the price of your order exceeds the credit balance of a gift voucher, you can pay the difference using the payment methods offered. If the price of your order is less than the credit balance of a gift voucher, you can redeem the remaining credit balance with your next order.
8.1.1.5 In the event of a contract being cancelled – for whatever reason – the purchase price will be refunded by means of a reversal entry to the voucher account and, if applicable, to the additional payment method used.
8.1.1.6 The gift voucher is transferable.
8.1.1.7 Lost voucher codes, in particular stolen voucher codes, will not be refunded. Westwing accepts no liability for lost voucher codes.
8.1.2 Promotional vouchers (including "Refer-a-friend vouchers")
8.1.2.1 Promotional vouchers are vouchers that are issued free of charge as part of advertising campaigns with a specific period of validity and cannot be purchased by you. Promotional vouchers can only be redeemed at the website specified on the voucher (www.westwing.ee, www.westwing.lv or www.westwing.lt)during the specified period, but cannot be used to cover shipping or assembly costs. Promotional vouchers may be subject to additional individual terms and conditions. These will be communicated to you in direct connection with the voucher.
8.1.2.2 Vouchers that you have received as a new customer based on an invitation from a Westwing member (so-called "refer-a-friend voucher") cannot be redeemed if you already have an account with Westwing, as the voucher is only redeemable by new customers.
8.1.2.3 First-time registration or new customer vouchers, which you receive once for registering on the websites www.westwing.ee, www.westwing.lv or www.westwing.lt, may only be redeemed once per customer account.
8.1.2.4 Only one promotional voucher can be redeemed per order. It is not possible to refund or credit any remaining balance of a promotional voucher that arises when the value of the purchase is less than the voucher value.
8.1.2.5 The promotional voucher is non-transferable, non-refundable and cannot be redeemed again if you return the goods or services paid for in whole or in part with the voucher within the statutory cancellation period. If you return ordered goods in part, the voucher value will be distributed proportionally among the goods ordered, i.e. in the event of the return of individual items, the voucher will be credited proportionally to the price of the returned goods and will expire in proportion to the value of the goods. If a voucher is linked to a minimum order value, this must also be reached if goods are returned in part, otherwise the voucher value will not be credited.
8.1.3 Compensation vouchers
8.1.3.1 Compensation vouchers are vouchers that cannot be purchased but are issued by Westwing at its own discretion as compensation without acknowledging any legal obligation.
8.1.3.2 The provisions applicable to promotional vouchers shall apply accordingly.
8.2 In the event of justified suspicion of fraud or other illegal or improper activities in connection with the purchase or redemption of a voucher, Westwing may block the corresponding voucher code (even temporarily) or refuse redemption (even temporarily). In the latter case, you have the right to cancel the order.
8.3 The voucher amount cannot be paid out, nor can it be transferred for value or subsequently offset against purchases already made, i.e. after completion of the order process.
8.4 The aforementioned vouchers can only be redeemed by consumers.
9. DELIVERY AND SHIPPING CONDITIONS
9.1 Deliveries are only made within Estonia, Latvia and Lithuania to the delivery address provided by you.
9.2. The standard delivery times will be communicated to you on the respective product detail page.
9.3 Ordered goods will be shipped either as a parcel or by a forwarding agent at Westwing's discretion.
9.4 Westwing does not assume any procurement risk, in particular in the case of generic purchases. Westwing is only obliged to deliver from existing stock or from goods ordered from suppliers. Westwing's delivery obligation shall lapse if, despite an existing covering transaction with the respective supplier, Westwing does not receive delivery, does not receive complete delivery or does not receive delivery on time and is not responsible for this, has informed you immediately and no separate procurement risk has been expressly agreed. Any advance payments shall be refunded by Westwing.
9.5 Westwing cannot be held liable for the non-fulfilment or defective fulfilment of the obligations entered into by Westwing under this contract if and to the extent that this is due to force majeure, notwithstanding the fact that Westwing shall do everything in its power to minimise the consequences of such an event.
Force majeure shall include all unforeseen events or events which, even if foreseeable, are beyond Westwing's control and whose effects on the performance of the contract could not be prevented by reasonable efforts on the part of Westwing. These include, among other things, war, war-like conditions, riots, rebellion, military or civil coups, insurrection, tumult, riots, embargo, government order, fire, floods, storm surges, hurricanes or other storms of catastrophic proportions, earthquakes, lightning strikes, pandemics, epidemics, nuclear hazards or similar causes beyond Westwing's control that make it illegal, impossible or economically unfeasible to fulfil or comply with the obligations set out in these GTC. If a case of force majeure occurs, Westwing is obliged to inform you immediately. Westwing is released from its obligation to perform for the duration of the event. Delivery and performance deadlines shall be extended appropriately. If the force majeure lasts longer than 8 weeks, Westwing and you are entitled to withdraw from the contract.
9.6 If delivery of the goods fails for reasons for which you are responsible, Westwing will charge you for the costs of a new delivery and reasonable storage costs from the date of the unsuccessful delivery. The new delivery will also be subject to a charge if the initial delivery was free of charge for you. We will inform you of the additional costs before redelivery and will only carry out the delivery with your consent. Please note that refusal to accept delivery does not constitute an effective exercise of your right of withdrawal and must be expressly declared to Westwing. Westwing reserves the right to withdraw from the contract if you do not give your consent to redelivery within 7 days. Any payments already made by you will be refunded by Westwing in this case. This also applies if you effectively exercise your right of withdrawal. In this case, the costs of the initial delivery (standard shipping) will also be refunded to you.
10. WARRANTY, LIABILITY AND TRANSPORT DAMAGE
10.1 The provisions of statutory liability for defects apply. Regarding claims for defects in used goods, consumers cannot object to defects that were indicated before the purchase.
10.2 For Lithuania the following restriction applies to contracts for the delivery of used goods: The limitation period for claims for defects is one year from delivery of the goods.
10.3 Notwithstanding mandatory statutory provisions, Westwing's liability is limited to cases of gross negligence or intentional misconduct on the part of Westwing.
10.4 The aforementioned limitations and exclusions of liability under Section 10.3 shall not apply if Westwing has fraudulently concealed the defect or has assumed a guarantee for the goods or where the liability cannot be limited or excluded under the applicable law.
10.5 If the goods are delivered with obvious damage to the packaging or contents, please report this to the delivery company and contact Westwing Customer Service (for Estonia: mailto:service@westwing.ee, for Lithuiania: service@westwing.lt and for Latvia: service@westwing.lv). This report has no effect on your warranty rights.
11. GUARANTEES
An additional guarantee only exists if it is explicitly stated and described on the product detail page.
12. RIGHT OF WITHDRAWAL FOR CONSUMERS
You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the following model withdrawal form for this purpose, but this is not mandatory:

The right of withdrawal does not apply or expires in the case of the following contracts:
for the delivery of goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery or which, after delivery, have been mixed with other goods in such a way that they cannot be separated due to their nature;
for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs
for the delivery of goods that are liable to deteriorate rapidly or whose expiry date would be exceeded quickly.
13. CONSEQUENCES OF REVOCATION
If you have revoked the purchase contract, we shall reimburse you for all payments we have received from you, including delivery costs, without delay and at the latest within fourteen (14) days of the day on which we receive notification of your revocation of the contract. We will use the same means of payment for the refund as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged for this refund. We may refuse to refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

The deadline is met if you send the goods before the expiry of the fourteen-day period. We shall bear the costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling by you that is not necessary for testing the condition, properties and functionality of the goods.
14. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
14.1 For all purchases of goods, Westwing grants you a voluntary right of return of 30 days from receipt of the goods, in addition to the statutory right of withdrawal in accordance with Section 12. With this voluntary right of return, you can withdraw from the purchase contract even after the 14-day withdrawal period (see Section 12) has expired by returning the goods to Westwing within 30 days of receipt.
However, in order to exercise the voluntary right of return, you must return the goods complete, in perfect condition and undamaged in their original sales packaging. Otherwise, Westwing reserves the right to refuse the return. We would like to point out that you bear the transport risk when returning the goods under the voluntary right of return. The voluntary right of return does not apply to the purchase of gift vouchers.
14.2 The refund will be made to the payment method you used for payment. If direct debit was chosen as the payment method, no objection to the direct debit is required.
14.3 Your statutory right of withdrawal (see section 12) is not affected by compliance with the conditions set out in this section 12 and remains independent of this. Until the expiry of the statutory right of withdrawal, only the statutory conditions listed there apply. This contractually granted (voluntary) right of return does not limit your statutory warranty rights, which remain unrestricted.
15. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL CANCELLATION
If you revoke the contract only for part of the goods in an order (partial revocation), Westwing will refund the payments for the goods covered by the revocation, including delivery and assembly costs (if not yet assembled). However, if (part of) the delivery and assembly costs would have been incurred even if you had only ordered the goods for which you are not revoking the contract, these costs are excluded from the refund.
16. RETENTION OF TITLE
The goods remain the property of Westwing until full payment has been made.

Westwing reserves the right to make changes to the website, rules and regulations, including these GTC, at any time. You will be notified about any material changes that might be made to the GTC via e-mail that you used to register to or place an order on www.westwing.ee, www.westwing.lv or www.westwing.lt. GTC applicable to your order are those in force at the time of your order, unless a change to these GTC is required by law or by official order (in which case they will also apply to orders you have placed previously).
23. FINAL PROVISIONS
23.1 For all matters arising from or in connection with the use of www.westwing.ee, www.westwing.lv or www.westwing.lt., the law of Estonia, Latvia, or Lithuania shall apply exclusively, determined by your country of residence from among the above, excluding the UN Convention on Contracts for the International Sale of Goods.
23.2 Should any provision be or become invalid or unenforceable, the remaining provisions shall remain valid. The invalid or unenforceable provisions shall be replaced by the relevant statutory provisions.
